An off-duty MTA officer won’t face a criminal charge in connection to the death of man in North Amityville last year, Attorney General Letitia James' office announced on Thursday.
On March 15, 2025, Richard Moffatt was driving his personal car on Route 110 when he struck Jose Francisco Escobar Vasquez, who died at the scene.
The investigation found that Moffatt was going between 43 and 47 mph in a 40-mph zone, which is not considered dangerous speeding by the Attorney General's office.
The report also says there are no traffic lights, signals or crosswalks in the area.
The Attorney General's office is required to investigate every time an officer is involved in a civilian death.
